1. Acceptance of Terms

By accessing or using QAP Tools, you agree to these Terms of Use. If you do not agree, do not use the service. Additional mandatory rights and obligations may apply under the law of your jurisdiction.

2. Eligibility

You must have legal capacity to accept these Terms under applicable law, or use the service with any authorization or consent required by applicable law. The service is not specifically directed to children.

3. Description of Service

QAP Tools provides AI-assisted tools for generating bug reports and test cases and for analyzing software issues. It may accept optional screenshots and may allow a user to transfer an eligible Issue Analyzer result into the Bug Report workflow. V1 is an anonymous service without user accounts.

4. AI-Generated Content

Outputs are produced with third-party artificial-intelligence services. They may be inaccurate, incomplete, inconsistent, inappropriate, or unsuitable for your purpose. QAP Tools does not guarantee any output, conclusion, classification, recommendation, or result.

5. Human Review

You must review and independently verify generated content before using, publishing, implementing, or relying on it. Do not use output as the sole basis for consequential decisions, production changes, security decisions, or representations to third parties.

6. No Professional Advice

QAP Tools and its outputs are not a substitute for professional QA judgment, security review, legal advice, compliance advice, safety review, or other professional assessment. You are responsible for obtaining appropriate expert review when needed.

7. User Responsibilities

  • Provide lawful content and accurate context appropriate for your request.
  • Review generated output and decide whether it is suitable.
  • Protect identifiers, devices, and browser sessions used to access the service.
  • Comply with applicable laws, third-party rights, policies, and contractual duties.
  • Maintain backups of any content you need; QAP Tools is not a permanent repository.

8. User Content

You retain ownership of content you submit and of any rights you may have in it. You represent that you have the rights, permissions, and lawful basis needed to submit the content and authorize its processing. You must not submit material that infringes another person's rights or violates confidentiality obligations.

9. Limited Rights to Process User Content

You grant QAP Tools only the limited, non-exclusive rights reasonably necessary to process, transmit, temporarily store where applicable, analyze, and use your content to generate requested output and to operate, maintain, secure, and protect the service. QAP Tools does not claim ownership of your User Content through these Terms.

10. Screenshots and Sensitive Information

Screenshots are optional and intended for temporary processing. Do not deliberately submit unnecessary secrets or highly sensitive information.

  • Passwords, API keys, tokens, financial credentials, or production secrets.
  • Government identifiers, health or biometric data, or precise location.
  • Children's personal information, trade secrets, or confidential customer information.
  • Content you are not authorized to disclose.

11. Prohibited Uses

  • Use the service for unlawful, fraudulent, infringing, or deceptive activity.
  • Create, distribute, facilitate, or test malware or credential theft without lawful authorization.
  • Seek unauthorized access to systems, data, accounts, networks, or third-party services.
  • Abuse, damage, disrupt, overload, probe, or interfere with the service or third-party systems.
  • Bypass or attempt to bypass security controls, quotas, file limits, rate limits, or availability restrictions.
  • Use abusive automation, scraping, or request patterns that impair the service or evade controls.
  • Upload content without necessary rights or deliberately submit unnecessary secrets or highly sensitive information.
  • Misrepresent AI output as verified professional advice or guaranteed fact.

12. Intellectual Property

The QAP Tools service, interface, branding, software, and original service materials are protected by applicable intellectual-property laws. Except for rights expressly granted by these Terms, no rights in the service are transferred to you. Rights in AI-generated output may vary by jurisdiction and underlying content; QAP Tools does not guarantee that output is unique or eligible for intellectual-property protection.

13. Feedback

If you voluntarily provide feedback about QAP Tools, you permit QAP Tools to use it without restriction or compensation to improve and operate the service, provided that this does not transfer ownership of unrelated User Content or override applicable privacy rights.

14. Third-Party Services

QAP Tools depends on third-party infrastructure, storage, data, and AI services, including Vercel, Upstash, and OpenAI. Their availability, processing, and applicable terms may affect the service. QAP Tools is not responsible for third-party services to the extent permitted by applicable law.

15. Usage, File, Rate, and AI Availability Limits

QAP Tools may enforce generation quotas, file-count and file-size limits, rate limits, concurrency controls, temporary-upload expiry, AI budget limits, and provider-availability restrictions. Limits may be applied or changed to protect users, control cost, preserve capacity, prevent abuse, or comply with provider requirements.

16. Availability and Changes

The service may be unavailable, delayed, modified, suspended, or discontinued, in whole or in part. QAP Tools does not guarantee uninterrupted or error-free operation, permanent availability of features or generated results, or continued support for a particular provider or model.

17. Suspension and Restriction

Access may be restricted or blocked where reasonably necessary to prevent abuse, protect security or availability, enforce these Terms, respond to legal requirements, or protect users or third parties. Because V1 has no accounts, restrictions may apply to sessions, network sources, requests, or service features.

18. Disclaimers

To the maximum extent permitted by applicable law, QAP Tools is provided on an “as is” and “as available” basis without warranties of accuracy, completeness, reliability, availability, non-infringement, merchantability, fitness for a particular purpose, or that defects will be corrected. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, QAP Tools will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, business, goodwill, security, or opportunity arising from use of or inability to use the service or reliance on generated content. Liability that cannot lawfully be excluded or limited remains unaffected.

20. Responsibility for Claims

Where legally permitted and appropriate, you are responsible for losses or claims resulting from your unlawful use of the service, violation of these Terms, infringement of third-party rights, or submission of content without required authority. This provision does not apply to the extent prohibited by applicable consumer or other mandatory law.

21. International Users

QAP Tools is accessible internationally, but availability does not mean the service is appropriate or lawful in every location. You are responsible for compliance with laws applicable to your use. Jurisdiction-specific mandatory protections remain unaffected.

22. Applicable Law and Disputes

Applicable law and the forum for any dispute depend on the facts, the parties, mandatory consumer protections, and conflict-of-law rules. These Terms do not designate a governing jurisdiction or require arbitration. Before formal proceedings, users are encouraged to contact QAP Tools to seek an informal resolution where appropriate.

23. Changes to the Terms

These Terms may be updated to reflect service, provider, legal, or operational changes. The revised Terms will state a new effective date. Continued use after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.

24. Severability and No Waiver

If a provision is held unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue where permitted. Failure to enforce a provision is not a waiver of the right to enforce it later.
